RWE AG is ultimately responsible for setting the policies for the RWE Group, and so we also comply with the RWE General Data Privacy Policy and other group directives relating to data protection and privacy.

4.1 Which of your personal information is used by us?

Every time you visit our website, our system automatically collects data and information from the system of the accessing computer. In addition to non-personal information (e. g. the domain name of the website which you came from; the websites that you visited on our domain; the names of the retrieved files (incl. date and time of the retrieval); the name of your Internet service provider; and, if applicable, the operating system and browser version of your computer; host name of the accessing computer; language settings), your IP address is processed.

This approach makes it easier for you to share your website visit on social networks and share your experiences in that context. We also use these cookies to exchange data about you with the operators of social networks. This data also enables us to offer you advertisements tailored to your interests.

The created usage profiles, including those exchanged with the operators of social networks, are pseudonymized and only then processed. This means that we can only assign the analysed advertising interests to the pseudonym, but not to you personally.

Microsoft Clarity

This website uses the "Clarity" service of Microsoft Corporation. Clarity enables an analysis of the use of our website. This creates a log of mouse movements and clicks with the intention of deriving potential improvements for the website from it. The information collected is transmitted to Clarity and stored there. According to Microsoft, this information can also be used for advertising purposes.
In particular, we process usage data (e.g. Internet presentations visited, interest in content, access times), meta/communication data (e.g. device information, IP addresses), Location data (information on the geographical position of a device or person), Movement data (mouse movements, scrolling movements) in pseudonymized form. We have made the appropriate settings so that the data collection to and by Microsoft is already pseudonymized.

The data processing is based on your consent which you have given by confirming the Analytical Cookies.

Microsoft Application Insights

Application Insights is a service of the Azure cloud platform of Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA ("Microsoft"). This service collects telemetry data from the application being used. This data is anonymous statistical data. It is not possible to establish a personal reference based on this data. The IP address used by the user is shortened and thus anonymized. Raw telemetry data is deleted after 90 days.

6 Contact Form

6.1 Which of your personal information is used by us?

On our website you have the possibility to contact us via a form. In the following we explain to you how we process your information in this context.

We process the data you provide in the respective form. These are: Salutation/Title, Name, Title, E-Mail, Address, Phone number, Company, and, if you are a Landowner, Plot number. In addition, you have the possibility to provide us with further data via a free text.

We process the data you provide in the relevant form. These are your name, an acquired academic title, your gender, your e-mail address, your address, your telephone or fax number, your company or institution for which you act and your respective department and your preferred language.

We need the data to be able to process your registration for the respective product or platform (e.g. supplier registration).

8 Newsletter

8.1 Which of your personal information is used by us?

On our website and via embedded frames on our presences in social media we offer you the possibility to subscribe to our newsletter.

To send the newsletter we process your name and e-mail address. In addition, we collect data about your subscription behaviour, for example, whether you read the newsletter or click on links listed there. These data are collected anonymously.

8.2 What are the sources of the personal information?

You enter your name and e-mail address during registration. In order to exclude errors, we use the so-called double opt-in procedure, in which after registration you receive an e-mail with a confirmation link and only if you have clicked this link you are added to the newsletter distribution list.

8.3 What do we do use your personal information for?

We use the data to send you our newsletter with information about the RWE Group. We also use the data about your subscription behaviour to improve our newsletter in order to provide you with topics that interest you.

9 Social media

9.1 Which of your personal information is used by us?

We use various social media to actively communicate with you. For this purpose, we have set up company websites in various social networks. Furthermore, we have included third party plug-ins on our website, especially social networks or other IT service providers. These plug-ins are forwarding or recommendation functions, display functions with which information that RWE shares about itself in social networks can also be displayed on our website and other third-party IT services that help to display information in a more understandable way. In order such plug-ins to work, their provider requires certain personal information about you (e.g. your IP address) and processes it.

In order to protect your privacy, this processing only takes place if you agree to it. Accordingly, you will not have access to the Plug-In until you agree to it. You declare your consent by allowing comfort cookies. The plug-in will only be loaded and data will only be passed on to the social network if you wish to do so by agreeing to the comfort cookies in the cookie banner.

To display the social media content in the newsroom we use the service "Flockler" from Flockler Oy Rautatienkatu 26 B 32, 33100 Tampere, Finland, which aggregates relevant social media channels and displays them on our website. By interacting with the respective content a connection to the Flockler servers is established. Your IP address will be transmitted. You have given consent to this by registering with the social network or by accepting our convenience cookies. In certain cases we use your information jointly with the provider of the social medium or plug-in (so-called joint control). We would like to point out, that we have no influence on all data and data processing procedures collected by the provider of the respective social medium or plug-in, nor are we aware of the full scope of data processing, its purposes or storage periods. We also do not have any information about the deletion of the collected data by the respective provider. Therefore, in certain cases we have to forward inquiries addressed to us to the respective provider.

By presenting our company in social media, we would like to actively communicate with you and offer you the opportunity to inform yourself about our products and services in this way.

We pass the data on to other Group companies within the Group. We do not pass on data to third parties. However, we do not have any information about who the respective social network is passing on your personal information to.

10 LinkedIn Insight Tag

10.1 Which of your personal information is used by us?

We use the LinkedIn Insight tag on our website for conversion tracking (visit action evaluation) by LinkedIn Ireland Unlimited Company (Attn: Legal Dept., Wilton Plaza, Wilton Place, Dublin 2, Ireland; "LinkedIn"). LinkedIn does not share any personal information with us, but only provides aggregate reports on website audience and ad performance. 11 Google Services

11.1 Which of your personal information is used by us?

We have integrated Google Maps on our website via an API. The service is provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Its parent company is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Further information on data processing by Google can be found in the Google Privacy Policy.

In addition, we use the Google Tag Manager service from Google. The Google Tag Manager is an auxiliary service and itself processes personal information only for technically necessary purposes. The Google Tag Manager takes care of loading other components, which in turn may collect data. The Google Tag Manager does not access this data. 13 Collection of personal information other than through our website

13.1 Sources of personal information

(a) In addition to through our website, we may collect your personal information when you interact with us directly in person, in writing, over the telephone.

(b) Sometimes we collect personal information about you from other sources where you have consented to the collection of the information from someone else, we are authorised by law to collect the information from someone else or it is unreasonable or impracticable to collect the information from you personally. 

(c) If you apply for a position with us, we may, with your consent, collect your personal information from third parties such as recruitment service providers, referees, former employers and educational institutions.

(d) Collection of personal information from third parties

  • (i) If we receive unsolicited personal information about you from a third party and it is clear to us that we should not have received that information, we will destroy or securely delete that information (if it is lawful and reasonable for us to do so).
  • (ii) If we collect your personal information from third parties in circumstances where you may not be aware that we have collected your personal information, and that information can be used to identify you, we will take reasonable steps to notify you of the collection and the circumstances that surround the collection.

13.2 Other types of information that we collect and purpose of collection

(a) The kinds of personal information we collect and hold about you will depend on the circumstances of collection, including whether we collect the information from you as a supplier, contractor, adviser, stakeholder, job applicant or in some other capacity.

  • (i) If you are a supplier or potential supplier to us, we may collect and hold your contact details including your name, address, phone number and email address, details about your professional capability, experience and industry reputation, information about your insurances and registrations and information about your financial capacity.
  • (ii) If you are a prospective employee, we may collect and hold personal information about prospective employees, including your qualifications and employment history. 
  • (iii) If you are a community representative or other stakeholder in one of our projects, we may collect your name, contact details and any other information you choose to provide to us.

(c) Unless the collection of sensitive information is permitted under privacy laws, we will only collect sensitive information with your consent and where that information is reasonably necessary for our functions.

14 Our general policy in relation to use and disclosure

14.1 Use and disclosure of personal information

(a) We use personal information for a variety of purposes to effectively conduct our business, projects and engage with the community concerning our business and projects including:

  • (iii) to address community concerns concerning our business or projects;

(a) We are aim to collaborate only with partners who that offer solutions that comply with privacy law. We selects our partners taking into consideration the adequacy of the technical and organizational measures implemented by them. 

(b) To help us carry out our business functions, we may disclose personal information about you to third parties, including:

  • (i) our related entities;
  • (ii) our contractors, suppliers and agents;
  • (iii) our professional advisers, such as auditors and lawyers;
  • (iv) government and regulatory authorities (as required or authorised by law or a court/tribunal order); and

(c) We will not sell, gift, rent or trade your personal information to any third parties.

14.3 Disclosure overseas

(a) We may disclose your personal information to members of the RWE Group, contractors or suppliers overseas.

(b) Where your personal information is disclosed overseas, we will seek to ensure that information is used, held and disclosed consistently with Australian Privacy Law and any other applicable laws and that the overseas recipient does not breach Australian Privacy Law.

15 Protecting personal information

15.1 Storing personal information

  • (a) We store your personal information in different ways, including in physical and electronic form on site and with third party storage providers.
  • (b) We maintain physical, electronic and procedural security measures to safeguard your personal information and to secure and protect it from misuse and unauthorised access, disclosure or interference.

15.2 What happens if we no longer need your personal information?

If we no longer need your personal information to achieve the purpose of processing or using for which it was collected, we will take reasonable steps to destroy or permanently de‐identify the information, unless we are required by law, or a court/tribunal order, to retain the information.

16 What rights do you have in connection with your personal information?

16.1 Access to personal information

(a) You may request access to personal information we hold about you by contacting our Privacy Officer in accordance with paragraph 18 of this policy.

(b) You have the right to obtain your personal data, in a structured, commonly used and machine-readable format, which you have provided to the controller and the processing of which is based on consent or on a contract with you.

(c) In exercising this right, you also have the right to obtain that the personal data concerning you be transferred directly from one controller to another, as far as this is technically feasible. The freedoms and rights of other persons must not be affected by this.

(d) We will respond to a request for access within a reasonable time, and give you access in the manner you request, if it is reasonable and practicable to do so, unless an exception in Australian Privacy Law applies. (For example, if providing this access may disclose information about another person we may need to refuse to grant you access.)

(e) We may need to verify your identity before we give you access to your personal information.

16.2 Requesting correction

(a) We take particular care that and implement appropriate measures to ensure that personal information are stored accurate and kept up to date.

(b) You may request us to correct any information about you which you think is inaccurate, incomplete or out of date. We will respond to a correction request within a reasonable time.

(c) If we correct your personal information that we have previously disclosed to another entity, and you ask us to tell the other entity about the correction, we will take reasonable steps to tell the other entity about the correction, unless it is impractical or unlawful to do so.

(d) If we refuse to allow you access to your personal information or to correct that information, then we will provide you with the reasons for our decision and will inform you of mechanisms available to complain about the refusal.

16.3 Withdrawal of consent

Where you have provided consent to the collection or use of personal information, you may revoke this consent at any time by contacting the Privacy Officer.

16.4 Deletion

You may request we delete the personal data concerning you and the controller is obliged to delete such data immediately, unless an exception is provided for by law.

17 Anonymity and pseudonyms

(a) As far as the processing of anonymous or pseudonymous data has the same benefits, we will prefer these.

(b) You have the option to remain anonymous, or to use a pseudonym when dealing with us where it is lawful and practical to do so. However, without your personal information we may not be able to provide you with our products and services or do business with you or the organisation with which you are connected.
